The Business Outreach Program Office monitors Metropolitan contracts awarded to firms who are not considered as small businesses. Each of these contracts require that Prime Contractors comply with the small business participation requirements at bid time and as set forth in the contract. In the event of non-compliance with the SBE requirements the district will consider appropriate remedies under its legal authority, including those provided for in the contract documents. These remedies may range from rejecting a bid, assessing monetary penalties to disqualifying a contractor from bidding on Metropolitan projects for a period of up to 5 years
The Compliance and Monitoring Program activities would include but not limited to the following:
- Provide Business Outreach Program requirements and information at pre-bid and pre-proposal conferences.
- Project site visits to monitor SBE participation and compliance.
- On site review of all Small Business work schedules and participation.
- Review of prime contractor's pay applications and payments to subcontractors and suppliers.
- Development of monthly and annual reports to determine the actual SBE utilization and participation level for each contract.
- Review and approval of all change orders, supplemental agreements, and substitution/additions affecting the small business participation levels.
- Continuos interfacing with Prime contractors to ensure that SBE activities are completed and funds expended in accordance with contract provisions as well as applicable State and Federal rules, regulations, policies, and related statutes.
The Contract Compliance and Monitoring component of the Metropolitan Business Outreach Program Office is responsible for monitoring Prime contractor compliance with regards to the Small Business Requirements (SBR) of respective construction and professional services contracts. This program component is designed to provide opportunities that encourage and facilitate the growth and development of Small Business contractors, consultants and vendors.
